Terms of Service — dhiyo
Version 1.0 · Last updated: 27 October 2026 · Effective: 27 October 2026
These Terms of Service (“Terms”) are a binding agreement between you and Tantransha LLP, a limited liability partnership registered in India (“dhiyo,” “we,” “us,” “our”), governing your access to and use of the dhiyo mobile application and related services (the “Services”) and everything you create, input, or generate in them (“Your Content”). By using the Services, you agree to these Terms. Contact: dhiyo@dhiyo.net.
Summary
This summary is for convenience only. Please read the full Terms below — they are what legally binds you and us. If anything here conflicts with the full Terms, the full Terms govern.
- dhiyo is for personal reflection, journaling, and entertainment. It is not medical, psychological, or crisis care, and nothing in it is professional advice.
- You must be 18 or older.
- Your use is at your own risk. AI output can be wrong — treat it as a reflection to think with, never as advice, therapy, or a fact about you.
- You own what you write, and you give us a broad licence to store and process it to run and improve the Services.
- We never sell your data and we run no ads. See our Privacy & Data Policy.
- The journal is free for as long as you keep it. dhiyo Plus gives complete access to all dhiyo features; crisis and safety resources are always free.
- We won’t block you from saving an entry — free user or subscriber — no matter what you write.
- You can export or delete your data anytime in my account.
- The Services are provided “as is,” our liability is limited, and these Terms are governed by Indian law with disputes heard in Indian courts.
1. Acceptance
By creating an account or using the Services, you agree to these Terms and to our Privacy & Data Policy, which is incorporated by reference. If you do not agree, do not use the Services.
2. Eligibility
You may use the Services only if: you are at least 18 years old (dhiyo is built for adults, is not directed to anyone under 18, and we do not knowingly permit under-18 use — if we learn a user is under 18 we can suspend or delete the account); you have the legal capacity to enter a binding contract where you live; and you are not barred from using the Services under applicable law. You represent and warrant this is true each time you use the Services.
3. Nature of the Services — important disclaimers
- dhiyo is a self-reflection, journaling, and entertainment tool for personal, non-clinical use.
- dhiyo is not a medical device or service, a healthcare or telehealth provider, a diagnostic tool, a substitute for therapy, counselling, or psychiatric care, an emergency or crisis service, or a provider of professional advice of any kind. No professional relationship is created by your use of the Services.
- AI output (dream interpretations, readings, conversation replies, and other generated material) is produced automatically, can be inaccurate, incomplete, or misleading, and is not a statement of fact about you. Do not rely on it, and do not treat it as advice, diagnosis, or therapy.
- You are responsible for your own decisions. You use the Services, and act on anything you take from them, at your own discretion and risk.
- If you are in crisis or may harm yourself or others, contact local emergency services immediately (for example, 911 in the US, 112 across the EU, 112/100/102/108 in India) or a professional. dhiyo is not a substitute for emergency help.
4. Your account
To use dhiyo you create an account with an email address (verified by a 6-digit code), a password, and a username, and you confirm you are 18 or older. You are responsible for safeguarding your credentials and for all activity under your account; use a strong, unique password. You may not create multiple accounts to evade safety features, limits, or restrictions. We are not liable for any loss arising from your failure to protect your account. Tell us immediately at dhiyo@dhiyo.net if you suspect unauthorized access.
5. Your Content and the rights you grant us
5.1 Ownership. You retain ownership of Your Content. What’s yours is yours.
5.2 Licence to us. By creating or submitting Your Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to host, store, reproduce, process, adapt, analyse, transmit, and display Your Content, and to create and use de-identified and aggregated data derived from it, in each case to operate, provide, secure, maintain, and to improve and develop the Services and our features and models. This licence authorizes us to transmit Your Content to our third-party AI and infrastructure providers to deliver features you use (Section 6) and to process it as described in the Privacy & Data Policy. No compensation is owed to you for these uses; your use of the Services is sufficient consideration.
5.3 Duration. This licence continues while Your Content is stored in the Services and ends when Your Content or your account is deleted per the Privacy & Data Policy — except that (a) de-identified and aggregated data that no longer identifies you may be retained and used indefinitely, and (b) copies may persist for a limited period in backups or where retention is required by law.
5.4 Your responsibility and warranty. You represent and warrant that you have all rights necessary to submit Your Content and to grant the licence above, and that Your Content does not violate any law or third-party right. You are solely responsible for Your Content.
5.5 Feedback. Any feedback, comments, or suggestions you provide are voluntary, and we are free to use them for any purpose without restriction, obligation, or compensation to you.
6. AI and third-party providers
The Services rely on third-party providers — including OpenAI (used to generate readings and conversation replies, and to turn recorded entries into text), Anthropic (maker of Claude, used for automated safety checks and other processing), and infrastructure, email, notification, and subscription-billing providers. When you use AI features, Your Content is transmitted to and processed by these providers under their own terms and privacy practices, over which we have no control and for which we are not responsible. AI output is generated automatically, may be wrong, and is provided for personal reflection and entertainment only (Section 3).
7. Data and privacy
Our handling of personal data is described in the Privacy & Data Policy. You acknowledge and agree that we may use de-identified and aggregated data derived from your use of the Services, including from Your Content, to analyse, improve, and develop the Services, related products, and our models, without further obligation to you.
8. Acceptable use
You agree not to, and not to attempt to, or help anyone else to:
- use the Services in violation of any law or these Terms;
- harass, threaten, harm, defame, or infringe the rights of any person;
- upload or generate unlawful content, or child sexual abuse material (which we can report to, and cooperate on with, law enforcement);
- circumvent, disable, or interfere with safety, security, or rate-limiting features — including through “jailbreaking,” “prompt injection,” or other attempts to override or manipulate the AI’s safety, security, or platform controls;
- access the Services other than through our published interfaces; scrape, crawl, or use automated means to access the Services without our written consent;
- reverse-engineer, decompile, or attempt to extract our source code, model prompts, or written content, or use the Services to build a competing product; or
- resell, sublicense, or commercially exploit the Services or our content.
We can remove content, limit its visibility, suspend or terminate accounts, reclaim usernames, and report violations to authorities — for any breach of this Section — without liability to you. We also reserve the right to access, preserve, and disclose any information where we reasonably believe it necessary to comply with law or a governmental request, enforce these Terms, detect or prevent fraud or security or technical issues, respond to support requests, or protect the rights, property, or safety of dhiyo, our users, or the public — in each case consistent with the Privacy & Data Policy.
9. Safety commitments
- We will not block you from saving an entry — whether you are a free user or a subscriber — regardless of what you write. Your record is yours.
- We surface crisis resources when content suggests acute risk, and provide a “Get help now” option at any time. These point you to people and services who can actually help; dhiyo does not itself provide crisis intervention (Section 3).
10. Subscriptions, billing, and free trials
The journal is free to use for as long as you keep your account. We offer one optional paid subscription, dhiyo Plus, which gives complete access to all dhiyo features without the free tier’s monthly limit. The following apply:
- Free tier and trial. Writing and keeping your dreams and journal entries is free for as long as your account is active. New accounts include a free trial of the full AI features (currently 21 days); after it ends, the free tier includes a limited monthly allowance of AI responses, after which AI features pause until the allowance resets or you subscribe to dhiyo Plus. Crisis and safety resources are never limited or paywalled, on any tier.
- Billing. Subscriptions are sold and billed through the Apple App Store or Google Play to your store account. Prices are shown before purchase and may vary by region and taxes.
- Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the current period ends. Your store account is charged within 24 hours before each renewal.
- No payment details for the trial. The free trial for new accounts needs no payment details and never turns into a paid subscription on its own; when it ends, your account simply moves to the free tier. If you subscribe to dhiyo Plus while your trial is still running, your subscription and its billing start straight away, and the remaining trial days are not added on.
- Free periods we give. We may give dhiyo Plus free for a period — for example to people helping us test, or through a promotional code. When that period ends your account returns to the free tier unless you subscribe; nothing is charged unless you choose to subscribe.
- Managing and cancelling. Manage or cancel in your Apple or Google account settings. Deleting the app does not cancel a subscription.
- Refunds. Except where required by law or the app-store’s policy, payments are non-refundable and there are no refunds or credits for partial periods. App Store / Google Play refund requests are handled by Apple or Google under their policies.
- EU/UK and similar consumers have a statutory 14-day right of withdrawal for digital content. By starting to use a paid feature within that period, you expressly request immediate performance and acknowledge that you lose the right of withdrawal once the digital service has been fully provided, to the extent permitted by law.
- Price changes apply to the next billing period after we give notice, and we obtain your consent where required.
11. Intellectual property
The Services — including the dhiyo name and brand, the app, its design, software, and all content other than Your Content — are owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Services for your personal, non-commercial use, subject to these Terms. Nothing grants you a right to use our name, trademarks, or brand features without our written consent. All rights not expressly granted are reserved.
12. Termination
You can delete your account at any time in my account; deletion follows the timeline in the Privacy & Data Policy. We can suspend or terminate your access, or stop providing all or part of the Services, at any time — with or without notice — if we reasonably believe you have violated these Terms, you create risk or legal exposure for us, your conduct is unlawful, your account has been inactive for a prolonged period, or our provision of the Services to you is no longer commercially viable; and, to the extent permitted by law, for any other reason at our convenience. We will make reasonable efforts to notify you where appropriate. On termination your licence to use the Services ends; Sections that by their nature should survive (including 3, 5, 6, 7, 8, 11, 13, 14, 15, 16, and 17) survive.
13. Disclaimers
To the extent permitted by law, the Services and all content are provided “as is” and “as available,” without warranties or guarantees of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting that, we make no warranty and disclaim responsibility and liability for: (i) the completeness, accuracy, availability, timeliness, security, or reliability of the Services or any output; (ii) any harm to your device, loss of data, or other harm resulting from your use of the Services; (iii) the deletion of, or failure to store or transmit, Your Content; and (iv) whether the Services will meet your requirements or be uninterrupted, secure, or error-free. No advice or information obtained from the Services creates any warranty not expressly stated here. dhiyo is not a medical device or service (Section 3).
14. Limitation of liability
To the extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or reliance, or for any harm arising from your use of, or inability to use, the Services or any AI output.
- You assume full responsibility and risk for your use of the Services and any decision or action you take based on them.
- Our total aggregate liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) INR 8,000 (approximately US $100).
These limitations apply to any theory of liability (contract, tort including negligence, statute, or otherwise), even if a remedy is found to have failed its essential purpose. If any part of this Section is held unenforceable, the limitation will apply to the greatest extent permitted by law. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law (such as for death or personal injury caused by our negligence, or for fraud).
15. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless dhiyo, its partners, employees, and contractors from any claim, loss, or expense (including reasonable legal fees) arising out of your use of the Services, Your Content, your violation of these Terms or any law, or your infringement of any third-party right.
16. Governing law, jurisdiction, and claims
These Terms are governed by the laws of India, without regard to conflict-of-laws principles. You and we submit to the exclusive jurisdiction of the competent courts in India for any dispute arising out of or relating to these Terms or the Services. To the extent permitted by law, you must bring any claim within one (1) year of the event giving rise to it, or it is permanently barred; and you waive any right to participate as a plaintiff or class member in any class, collective, or representative action. Nothing in this Section deprives you of the protection of mandatory rules of your country of habitual residence that cannot be excluded by agreement, including the right, where it applies, to bring proceedings in your local courts.
17. Changes, additional terms, and general
- Changes. We may modify or discontinue the Services or change these Terms; we will update the “Last updated” date and, for material changes, provide notice in the app (at least 30 days in advance where required). Continued use after changes take effect is acceptance.
- Additional terms. Some features (including paid features) may have additional terms, which become part of this agreement when you use them and prevail over these Terms to the extent of any conflict for those features.
- App stores. These Terms are between you and dhiyo, not Apple or Google. The store is not responsible for the Services or their support, and Apple and Google are third-party beneficiaries who may enforce these Terms. You represent you are not located in an embargoed country or on a prohibited-party list.
- Severability; no waiver; entire agreement; assignment; force majeure. If a provision is unenforceable, the rest remain in effect. Our not enforcing a provision is not a waiver. These Terms and the Privacy & Data Policy are the entire agreement about the Services. You may not assign these Terms; we may. We are not liable for delays or failures caused by events beyond our reasonable control.
- Language. These Terms are written in English; if a translation conflicts, the English version controls.
- Electronic communications. You consent to receive communications electronically (in-app or email), which satisfy any legal requirement of writing.
